THIS NOTICE GOVERNS THE REAL RADIOLOGY RECRUITING AND OPERATIONS TEXT MESSAGING PROGRAM. PLEASE REVIEW IT CAREFULLY. (If you have any questions about this notice, please contact Charles R. Stevens, CEO, at 303-590-9795.)

3. PROGRAM DESCRIPTION

Real Radiology operates a text messaging program (the “Program”) for the purpose of communicating with licensed radiologists and other professional contacts regarding independent contractor opportunities, candidate engagement, credentialing milestones, scheduling, onboarding, and operational notifications. Messages sent through the Program may include:

  • Initial outreach regarding 1099 independent contractor opportunities
  • Follow-up communications with engaged candidates
  • Credentialing status and document-collection reminders
  • Scheduling confirmations and shift reminders for engaged contractors
  • Onboarding instructions and system-access notifications
  • Operational notices related to active engagements

4. HOW TO OPT IN

You will receive messages through the Program only after providing consent through one or more of the following methods:

  • Submission of a contact, careers, or interest form on a Real Radiology website that includes a clearly disclosed, unchecked SMS consent checkbox naming Real Radiology as the sender.
  • Verbal opt-in collected by a Real Radiology recruiter or operations staff member during a telephone conversation. The recruiter will log the date, time, telephone number, and the substance of the consent.
  • Affirmative reply (for example, “YES”) to an initial outreach message that identifies Real Radiology, describes the purpose of contact, and discloses opt-out instructions. The initial outreach itself is sent only where Real Radiology has a good-faith basis under applicable law to make professional contact regarding the recipient’s licensed practice.
  • Execution of a Professional Services Agreement or similar engagement document that includes SMS communication consent.

5. ONE-TO-ONE CONSENT

Your consent to receive messages from the Program is specific to Real Radiology, LLC and is not transferable to any other party. Real Radiology does not seek consent on behalf of, or share SMS consent records with, any other entity for marketing or promotional purposes.

6. MESSAGE FREQUENCY

Message frequency varies based on your engagement with us and the nature of the communications. A few messages per month is typical. During active credentialing, onboarding, or scheduling, frequency may temporarily increase.

7. COST

Real Radiology does not charge for messages sent or received through the Program. Message and data rates may apply from your wireless carrier. Please contact your wireless carrier for information about applicable rates and plans.

8. HOW TO OPT OUT

You may opt out of the Program at any time by replying STOP to any message. The following keywords will be honored: STOP, END, CANCEL, UNSUBSCRIBE, QUIT. After we receive your opt-out request, you will receive a single confirmation message acknowledging the opt-out, after which no further messages will be sent through the Program.

Opt-out requests are honored promptly and are retained for a minimum of ten years following receipt, consistent with applicable state law. Opt-out from the Program does not terminate any other relationship with Real Radiology and does not affect non-SMS communications, including email and telephone communications, which are governed by their own opt-out mechanisms.

10. SUPPORTED CARRIERS

The Program supports messaging through major United States wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, Cricket Wireless, MetroPCS, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to the availability of carrier networks and is not guaranteed.

11. PRIVACY

Mobile information and consent to receive SMS will not be sold, rented, or shared with any third party or affiliates for marketing or promotional purposes. Information collected through the Program is governed by our Website Privacy Policy, which describes the categories of information we collect, how we use and share that information, and your rights with respect to that information. The Website Privacy Policy is available at realradiology.com/privacy and is incorporated into these SMS Terms of Service by reference.

12. ELIGIBILITY

The Program is intended for individuals who are at least eighteen years of age and who hold a wireless telephone number assigned by a United States wireless carrier. By participating in the Program, you represent and warrant that you meet these eligibility requirements and that you are the authorized user of the wireless telephone number provided.

12.1 Informal Resolution

Before initiating arbitration or any other formal proceeding, the parties will attempt in good faith to resolve any dispute arising out of or relating to these Terms or the Sites through informal negotiation. The party initiating the dispute will provide written notice to the other party describing the nature of the dispute and the relief sought. If the dispute is not resolved within thirty days of the written notice, either party may proceed under Section 12.2.

13. ACCURACY OF INFORMATION

You agree to provide accurate and complete information when opting in to the Program. You also agree to promptly notify Real Radiology if you change or relinquish your wireless telephone number. Failure to update your information may result in messages being sent to a number that you no longer control.

14. DISCLAIMER

Real Radiology is not responsible for any delay, failure, or interruption in the delivery of messages caused by carrier networks, technical failures, your handset or service, or any other circumstance beyond Real Radiology’s reasonable control. Messages sent through the Program are intended for general informational and operational purposes and do not constitute professional, medical, legal, or financial advice. Engagement decisions, credentialing decisions, and similar matters are governed by separate written agreements and processes; nothing in any message constitutes a binding offer or commitment except as expressly stated in a fully executed written agreement.

15. CHANGES TO THESE TERMS

Real Radiology may modify these SMS Terms of Service from time to time. The effective date at the top reflects the date of the most recent revision. Material changes will be communicated through our websites and, where appropriate, through direct notice. Continued participation in the Program following any modification constitutes acceptance of the revised SMS Terms of Service.

16. GOVERNING LAW

These SMS Terms of Service are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws principles, except to the extent that applicable consumer-protection or telecommunications laws of your state of residence provide otherwise.
